Welcome to MENSLACE. The terms "we," "us," and "our" refer to MENSLACE, an independent art studio. MENSLACE operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you — the customer — with a curated shopping experience (the "Services").
The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when using the Services.
Please read these Terms carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (menslaceart.com/policies/privacy-policy). If you do not agree, you should not use or access our Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services — including browsing our store or purchasing products — you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 — OUR PRODUCTS
We have made every effort to accurately represent our products in our store. However, please note that colors, tones, and print appearance may vary from what you see on your screen due to differences in display settings, monitor calibration, and device type. This is especially relevant for fine art and photo prints, where color accuracy is best evaluated on a calibrated display.
We do not warrant that the appearance or quality of any product purchased will meet your expectations or match exactly what is depicted in our store.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. MENSLACE reserves the right to accept or decline any order at its discretion. Your order is not accepted until MENSLACE confirms acceptance and payment is successfully processed.
Please review your order carefully before submitting. Because many of our prints are made to order and sent directly to our fulfillment lab, we may be unable to accommodate cancellation requests once an order is accepted and production has begun. In the event we cannot accept, modify, or must cancel an order, we will notify you using the contact information provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy (menslaceart.com/policies/refund-policy) .
Purchases are intended for personal or household use only and may not be resold or exported commercially.
SECTION 4 — PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, or handling charges.
We may offer promotions from time to time that affect pricing and are governed by separate terms. Where promotion terms conflict with these Terms, the promotion terms will govern.
You agree to provide current, complete, and accurate payment and account information for all purchases. You agree to keep your account information — including email address and payment details — up to date so we can complete your transactions and contact you as needed.
You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorized to use the payment method provided, (iii) charges will be honored by your payment provider, and (iv) you will pay all charges incurred, including shipping and applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
MENSLACE is not liable for shipping or delivery delays. All delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, or any events outside our control.
Once your order is transferred to the carrier, title and risk of loss passes to you.
Please note: Orders containing both Mail Club items and print orders will ship separately and may arrive at different times. Mail Club items ship via envelope and do not include tracking. Print orders are fulfilled through our professional print lab and will include a tracking number.
SECTION 6 — INTELLECTUAL PROPERTY
All content on our Services — including but not limited to artwork, photographs, images, graphics, text, video, audio, trademarks, and the design and arrangement thereof — is owned by MENSLACE or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.
Purchase of a print or product does not transfer any copyright, reproduction rights, or intellectual property rights to the buyer. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or commercially exploit any artwork or content from MENSLACE without prior written consent.
These Terms permit use of our Services for personal, non-commercial purposes only. All rights not expressly granted herein are reserved by MENSLACE. Unauthorized use may constitute a violation of federal and state intellectual property laws.
MENSLACE's name, logo, and related marks are trademarks of MENSLACE and may not be used without prior written permission.
SECTION 7 — THIRD-PARTY TOOLS
You may have access to third-party tools through our Services. These tools are provided "as is" and "as available" without warranties or endorsement of any kind. MENSLACE has no liability arising from your use of any third-party tools, and such use is entirely at your own risk. We encourage you to review the terms of any third-party provider before use.
We may introduce new features or tools in the future, which will also be subject to these Terms.
SECTION 8 — THIRD-PARTY LINKS
Our Services may contain links or references to third-party websites or embedded functionality. We are not responsible for the content, accuracy, or practices of any third-party sites. If you choose to leave our Services to access third-party content, you do so at your own risk.
We are not liable for any harm or damages related to your use of third-party websites or your purchase of products or services from third parties. Please review third-party policies carefully before engaging in any transaction. Complaints or concerns regarding third-party products should be directed to the relevant third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
MENSLACE operates its store using Shopify as its e-commerce platform. However, all sales and purchases are made directly with MENSLACE. By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and MENSLACE, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims arising from your transactions with MENSLACE.
SECTION 10 — PRIVACY POLICY
All personal information collected through our Services is subject to our Privacy Policy Privacy Policy (menslaceart.com/policies/privacy-policy). By using the Services, you acknowledge that you have read and understood our privacy practices.
As our store is hosted on Shopify, Shopify also collects and processes certain information related to your use of the Services in accordance with Shopify's Privacy Policy. Information submitted through our Services may be shared with Shopify and select third parties to facilitate your transactions and improve the Services.
SECTION 11 — FEEDBACK
If you submit ideas, suggestions, reviews, or other feedback (collectively, "Feedback"), you grant MENSLACE a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such Feedback in any medium for any purpose, including operating, improving, and promoting our Services.
You represent and warrant that: (i) you own or have all necessary rights to any Feedback you submit; (ii) you have disclosed any compensation or incentives received in connection with your Feedback; and (iii) your Feedback complies with these Terms.
We are under no obligation to maintain Feedback in confidence, compensate you for Feedback, or respond to it. We may, but are not obligated to, monitor, edit, or remove Feedback that we determine to be unlawful, offensive, defamatory, or otherwise objectionable, or that violates any party's intellectual property rights.
You are solely responsible for your Feedback and its accuracy. MENSLACE takes no responsibility for Feedback posted by you or any third party.
SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS
Our store may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors or inaccuracies and to update or cancel orders where information is found to be incorrect, at any time and without prior notice — including after an order has been submitted.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable laws or regulations; (c) to infringe upon our intellectual property rights or those of others; (d) to harass, harm, defame, or intimidate any person; (e) to transmit false or misleading information; (f) to send unsolicited advertising or promotional material, including spam or chain letters; (g) to impersonate any person or entity; or (h) to engage in any conduct that restricts or inhibits anyone's use of the Services or that may expose MENSLACE or its users to liability.
You also agree not to: (a) upload viruses or malicious code; (b) reproduce, resell, or exploit any portion of the Services; (c) collect personal information of others; (d) use automated tools, scrapers, bots, or AI agents to access the Services without authorization; or (e) interfere with or circumvent any security or access controls.
We reserve the right to suspend or terminate your account at any time, without notice, if we determine you have violated these Terms.
SECTION 14 — AGENTS
This section applies if you use or enable any automated software or service ("Agent") to access or interact with our Services. Agents must identify themselves in all requests, may not mimic human behavior or circumvent CAPTCHAs, must respond truthfully when asked if interactions are from a human or computer, and may not circumvent any measures we use to control Agent access. We may limit or block Agent access at any time by any means we deem appropriate.
SECTION 15 — TERMINATION
We may terminate this agreement or your access to the Services at any time, at our sole discretion and without notice. You remain liable for all amounts due through the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Privacy Policy, and any provisions that by their nature should survive.
SECTION 16 — DISCLAIMER OF WARRANTIES
Information provided through our Services is for general informational purposes only. We do not warrant its accuracy, completeness, or usefulness, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY MENSLACE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, MENSLACE, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless MENSLACE and its affiliates, partners, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising out of: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your use of the Services.
We will notify you of any indemnifiable claim. We may control the defense and settlement of such claims at your expense but will not settle any claim requiring non-monetary obligations from you without your consent.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the fullest extent permitted by law and severed from the remaining Terms, which will continue in full force and effect.
SECTION 20 — WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with any policies posted on our site, constitute the entire agreement between you and MENSLACE regarding your use of the Services and supersede all prior agreements, communications, or proposals.
SECTION 21 — ASSIGNMENT
You may not transfer or assign these Terms or any rights under them without our prior written consent. MENSLACE may transfer or assign these Terms without notice to you.
SECTION 22 — GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota. You and MENSLACE consent to the exclusive jurisdiction and venue of the courts located in Minnesota for any disputes arising under these Terms.
SECTION 23 — HEADINGS
Section headings are included for convenience only and do not affect the interpretation of these Terms.
SECTION 24 — CHANGES TO TERMS OF SERVICE
We reserve the right to update or replace these Terms at any time. We will notify you of material changes in accordance with applicable law. Your continued use of the Services following any changes constitutes acceptance of the updated Terms. The most current version will always be available on this page.
